Terms of Service

These Terms of Service ("Terms") govern your use of the Fotovera iOS application ("Fotovera," "the app") operated by Omnivera Pte. Ltd. (UEN 202628189M) ("we," "us," "our"), a company incorporated in Singapore.

By downloading or using Fotovera, you agree to these Terms. If you don't agree, please don't use the app.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Fotovera on iOS devices you own or control, subject to these Terms and Apple's App Store Terms of Service.

You may NOT:

Reverse engineer, decompile, or attempt to extract source code
Distribute, sell, sublicense, or rent Fotovera
Use Fotovera for any illegal purpose
Remove or alter any copyright or proprietary notices

2. Subscriptions and pricing

Fotovera offers three paid tiers:

Monthly: $4.99/month, with optional 7-day free trial
Annual: $19.99/year, with optional 7-day free trial
Lifetime: $29.99 one-time payment

All purchases are processed by Apple. We do not have access to your payment information.

Free trials

If you choose a free trial:

The trial lasts 7 days from purchase
We will notify you in-app at least 24 hours before the trial ends and the subscription begins
You can cancel anytime during the trial in iOS Settings → [Your Apple ID] → Subscriptions
If you don't cancel before the trial ends, your subscription will automatically begin at the listed price

Auto-renewal

Monthly and Annual subscriptions auto-renew unless you cancel at least 24 hours before the current period ends. Apple charges your payment method on file for each renewal period.

Cancellation

You can cancel any subscription at any time:

Open iOS Settings → tap your Apple ID at the top → tap Subscriptions → tap Fotovera → tap Cancel Subscription
Or use the in-app Manage Subscription button (Settings → Manage Subscription) which deep-links to the same iOS screen

Cancellation takes effect at the end of your current billing period. You retain access until then.

Lifetime purchase

The Lifetime tier is a one-time purchase. It includes:

Access to all Fotovera premium features
Free updates for the life of the app on iOS

It does NOT include:

Access to separate Fotovera products that may launch in the future
Server-hosted services (Fotovera does not have any)

If Fotovera is discontinued or removed from the App Store, your lifetime access continues on devices where the app is already installed, until those devices are reset or the app is uninstalled.

3. Refunds

All refund requests are handled directly by Apple per their App Store Refund Policy. To request a refund:

Visit reportaproblem.apple.com
Sign in with your Apple ID
Find Fotovera and select your reason for refund

We do not have access to your payment information and cannot issue refunds directly. However, if Apple denies a refund and you believe you have a valid concern, contact us through our contact form and we will review your case and may issue a goodwill credit at our discretion.

4. How Fotovera works (and disclaimers)

Fotovera uses on-device algorithms (perceptual hashing, Vision framework) to identify duplicate, blurry, screenshot, and large-video files in your Photos library. Detection is suggestive, not authoritative. You confirm each deletion.

We do NOT guarantee:

That all duplicates will be identified
That no false positives will occur
That every blurry photo will be flagged
That deleted photos are recoverable beyond Apple's native Recently Deleted album

Use Apple's "Recently Deleted" album (Photos app → Utilities → Recently Deleted) to recover any photo within 30 days of deletion. Beyond 30 days, photos are permanently removed by iOS.

We are not responsible for:

Photos accidentally deleted through Fotovera
Photos lost due to iCloud sync, iOS bugs, or hardware failure
Any data loss arising from your use of the app

Back up your photos before using any cleanup tool, including Fotovera. We recommend enabling iCloud Photos or another backup before bulk deletion.

5. Intellectual property

Fotovera, including the app, branding, copy, design, and source code, is owned by Omnivera Pte. Ltd. and protected by copyright, trademark, and other laws.

Your photos remain entirely yours. We claim no rights over them.

6. User conduct

You agree not to:

Use Fotovera to view, manage, or delete photos you don't have the legal right to access
Use Fotovera to harass, defame, or harm any person
Attempt to circumvent the subscription system
Reverse engineer the duplicate detection algorithms

7. Disclaimer of warranties

Fotovera is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Fotovera will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of liability

To the maximum extent permitted by law, in no event will Omnivera Pte. Ltd., its affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Fotovera, even if advised of the possibility of such damages. Our total cumulative liability to you for any claim arising out of or relating to Fotovera will not exceed the amount you paid us in the twelve months preceding the claim, or USD $50, whichever is greater.

Some jurisdictions don't allow the exclusion or limitation of certain damages. If those laws apply to you, some or all of the limitations above may not apply.

9. Indemnification

You agree to defend, indemnify, and hold harmless Omnivera Pte. Ltd. and its affiliates from any claims, damages, losses, or expenses arising out of your violation of these Terms or your use of Fotovera.

10. Termination

We may terminate or suspend your access to Fotovera at any time, with or without cause, with or without notice. Upon termination, your right to use Fotovera ceases immediately. Sections 4 (disclaimers), 7 (warranty disclaimer), 8 (liability limitation), and 9 (indemnification) survive termination.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in-app. Continued use after changes means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Singapore, without regard to conflict of laws principles. Any dispute will be resolved in the courts of Singapore.

13. Apple's terms also apply

Your use of Fotovera is also subject to Apple's App Store Terms of Service. To the extent of any conflict, Apple's terms govern as they relate to App Store distribution.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
